本服务条款（下称“本条款”）适用于你使用 Campiya LLC（一家新墨西哥州有限责任公司，下称“Campiya”或“我们”）提供的 campiya.com 及相关服务（下称“本服务”）。你注册账户或使用本服务，即表示同意本条款。如果不同意，请不要使用本服务。本中文版本仅供参考，与英文版本不一致的，以英文版本为准。

一、使用资格和账户

你须年满 13 岁才能使用本服务。未满 18 岁的，须经父母或法定监护人同意。你同意提供真实信息，妥善保管密码，发现账户被他人未经授权使用时及时告知我们。你对自己账户下的活动负责。账户仅限本人使用，不得共享或转让。

二、本服务

Campiya 是一款 AI 学业咨询助手，提供关于课程、学位要求和校园流程的一般性信息。我们可能随时变更、暂停或终止本服务的任何部分。

三、关于 AI 回答的重要提示

回答由人工智能生成，可能不完整、过时或有误。本服务只提供一般性信息，不构成官方的学业、法律、移民、财务或医疗建议。选课注册、学位要求、截止日期、签证和助学金等重要决定，请务必以学校官方信息、你的学业顾问或其他专业人士的意见为准。你对自己的决定负责。

Campiya 是独立服务，与加州大学、加州大学戴维斯分校或任何其他学校没有隶属关系，也未获其认可或赞助。提到学校名称，只是为了说明本服务涵盖的信息范围。

四、积分和付费方案

部分功能可能需要积分或付费方案。价格、各方案包含的内容以及积分的使用方式，会在你购买前展示。

• 付款由第三方支付机构处理，你同意遵守其条款。
• 积分没有现金价值，不能转让或兑换现金，只能在本服务中使用。方案所含积分可能按购买时说明的规则到期。
• 包时套餐和加油包都是一次性购买。包时套餐在购买时说明的有效期内提供，到期自动结束，不会续期或自动续费。除非你再次购买，我们不会再向你扣款。
• 退款按《退款政策》办理，《退款政策》是本条款的一部分。
• 我们可能调整今后购买的价格，已完成的购买不受影响。

五、使用规范

你同意不会：

• 以违反法律或学校学术诚信规定的方式使用本服务
• 提交违法、有害、骚扰他人或侵犯他人权利的内容
• 试图访问其他用户的账户或数据，或干扰本服务的安全或运行
• 以自动化方式抓取、复制或提取本服务或其内容，或利用本服务开发竞争产品
• 对本服务进行反向工程，法律禁止此项限制的除外
• 规避使用限制、积分或付款
• 未经我们书面许可，转售本服务或向他人提供本服务

六、你的内容

你对自己提交的问题和其他内容（下称“你的内容”）保留所有权。你授予 Campiya 一项全球范围、非独占、免许可费的许可，按隐私政策所述托管、存储、处理和使用你的内容，用于提供、维护、保护和改进本服务。你对你的内容负责，并确认你有权提交这些内容。

在遵守本条款的前提下，你可以把从本服务获得的回答用于个人用途。其他用户也可能获得类似的回答。

七、我们的知识产权

本服务，包括软件、设计、文字、图形以及 Campiya 名称和标识，归 Campiya 或其许可方所有，受法律保护。除本条款给予你的有限使用权外，我们不授予你任何权利。

八、意见反馈

你向我们提出的建议或反馈，我们可以不受限制地使用，无需向你支付报酬。

九、第三方服务

本服务可能链接到或依赖第三方网站和服务，例如学校网站和支付机构。我们不对第三方服务负责，你使用第三方服务时适用其自身的条款。

十、暂停和终止

你可以随时停止使用本服务，并要求删除账户。如果你违反本条款、法律有要求，或为保护本服务和其他用户，我们可以暂停或终止你的访问。按其性质应在终止后继续有效的条款继续有效，包括关于你的内容、知识产权、免责声明、责任限制、赔偿和适用法律的条款。

十一、免责声明

十二、责任限制

在法律允许的最大范围内，对于因本服务产生或与本服务相关的任何间接、附带、特殊、后果性、惩戒性或惩罚性损害，以及任何利润、数据、学业机会或商誉的损失，Campiya 不承担责任。Campiya 对与本服务相关的全部索赔承担的总责任，以索赔前 12 个月内你向 Campiya 支付的金额与 50 美元两者中的较高者为限。部分法域不允许上述限制，因此可能不适用于你。

十三、赔偿

在法律允许的范围内，因你违反本条款或滥用本服务而产生的索赔、损失和费用（包括合理的律师费），你应向 Campiya 及其成员、管理人员和服务商作出赔偿，并使其免受损害。

十四、适用法律和争议解决

本条款适用美国新墨西哥州法律，不适用其冲突法规则。提起索赔前，你同意先发邮件到 support@campiya.com，与我们尝试非正式解决争议至少 30 天。未能解决的争议，只能向新墨西哥州伯纳利欧县（Bernalillo County）的州法院或联邦法院提起，你和 Campiya 同意接受其管辖。符合条件的，任何一方也可以改向小额索赔法庭提起个人索赔。本条不限制你所在地法律规定不可放弃的权利。

十五、条款更新

我们可能不时更新本条款。如有重大变更，我们会发布更新后的条款并更新生效日期，必要时也会通过邮件通知你。变更生效后你继续使用本服务，即表示接受更新后的条款。

十六、其他

本条款与隐私政策构成你与 Campiya 之间关于本服务的完整协议。任何条款被认定无法执行的，其余条款继续有效。我们未执行某项条款，不构成对该条款的放弃。未经我们同意，你不得转让本条款。我们可以因合并、收购或资产出售转让本条款。本条款有多种语言版本的，以英文版本为准。

Campiya Terms of Service

These Terms of Service ("Terms") govern your use of campiya.com and related services (the "Service") provided by Campiya LLC, a New Mexico limited liability company ("Campiya", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission of a parent or legal guardian. You agree to provide accurate information, keep your password secure and tell us promptly about any unauthorized use of your account. You are responsible for activity under your account. Accounts are for individual use and may not be shared or transferred.

2. The Service

Campiya is an AI academic advising assistant that provides general information about courses, degree requirements and campus procedures. We may change, suspend or discontinue any part of the Service at any time.

3. Important notice about AI answers

Answers are generated by artificial intelligence and may be incomplete, outdated or wrong. The Service provides general information only and is not official academic, legal, immigration, financial or medical advice. Always confirm important decisions, such as enrollment, degree requirements, deadlines, visa matters and financial aid, with official university sources, your academic advisor or other qualified professionals. You are responsible for your own decisions.

Campiya is an independent service. It is not affiliated with, endorsed by or sponsored by the University of California, UC Davis or any other school. School names are used only to describe the information the Service covers.

4. Credits and paid plans

Some features may require credits or a paid plan. Prices, what each plan includes and how credits are used are shown before you buy.

• Payments are processed by third-party payment processors, and you agree to their terms.
• Credits have no cash value, cannot be transferred or exchanged for cash and may be used only on the Service. Credits included in a plan may expire as described at the time of purchase.
• Plans and credit packs are one-time purchases. A plan lasts for the period stated at the time of purchase and then ends automatically. Plans do not renew, and we will not charge you again unless you make a new purchase.
• Refunds are handled under our Refund Policy, which is part of these Terms.
• We may change prices for future purchases. Price changes do not affect purchases you have already made.

5. Acceptable use

You agree not to:

• Use the Service in a way that violates any law or your school's academic integrity rules
• Submit content that is unlawful, harmful or harassing, or that infringes the rights of others
• Try to access other users' accounts or data, or interfere with the security or operation of the Service
• Scrape, copy or extract the Service or its content by automated means, or use the Service to build a competing product
• Reverse engineer the Service, except where this restriction is prohibited by law
• Get around usage limits, credits or payment
• Resell the Service or provide it to others without our written permission

6. Your content

You keep ownership of the questions and other content you submit ("Your Content"). You grant Campiya a worldwide, non-exclusive, royalty-free license to host, store, process and use Your Content to provide, maintain, secure and improve the Service, as described in our Privacy Policy. You are responsible for Your Content and confirm that you have the right to submit it.

Subject to these Terms, you may use the answers you receive from the Service for your own personal purposes. Other users may receive similar answers.

7. Our intellectual property

The Service, including its software, design, text, graphics and the Campiya name and logo, is owned by Campiya or its licensors and is protected by law. Apart from the limited right to use the Service under these Terms, we grant you no rights in it.

8. Feedback

If you send us suggestions or feedback, we may use them without restriction and without compensation to you.

9. Third-party services

The Service may link to or rely on third-party websites and services, such as university websites and payment processors. We are not responsible for third-party services, and your use of them is governed by their own terms.

10. Suspension and termination

You may stop using the Service and ask us to delete your account at any time. We may suspend or terminate your access if you violate these Terms, if the law requires it, or to protect the Service or other users. Provisions that by their nature should survive termination will survive, including those on Your Content, intellectual property, disclaimers, limitation of liability, indemnification and governing law.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CAMPIYA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY ANSWER WILL BE ACCURATE OR COMPLETE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAMPIYA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, ACADEMIC OPPORTUNITIES OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. CAMPIYA'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO CAMPIYA IN THE 12 MONTHS BEFORE THE CLAIM AND US$50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

13. Indemnification

To the extent permitted by law, you will indemnify and hold harmless Campiya and its members, officers and service providers from any claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Service.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict of law rules. Before filing a claim, you agree to contact us at support@campiya.com and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be brought only in the state or federal courts located in Bernalillo County, New Mexico, and you and Campiya consent to their jurisdiction. Either party may instead bring an individual claim in small claims court if it qualifies. Nothing in this section limits rights that cannot be waived under the laws of the place where you live.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date, and where appropriate we will also notify you by email. If you continue to use the Service after the changes take effect, you accept the updated Terms.

16. General

These Terms, together with our Privacy Policy, are the entire agreement between you and Campiya about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets. If these Terms are provided in more than one language, the English version controls.
